WHAT WE COLLECT

When you create an account or register for our course, you may be asked to provide personal information such as your first name, last name, email address, street address including city, state, and zip code, phone number, date of birth, social security number, username and password, employer, billing, and credit card information. We may also obtain information about you from third party sources, such as public databases and websites, and your employer.

As with most websites, TABC On The Fly utilizes log files and may collect device information and usage data that may include (i) identifiers, such as user identification, organization identification, username, email address and user type; (ii) commercial information; and (iii) internet activity information such as IP address (or proxy server information), mobile device number, device and application identification numbers, location, browser type, Internet service provider or mobile carrier, user interactions such as the type and number of pages and files viewed, website and webpage interactions including searches and other actions you take, operating system type and version, system configuration information, date and time stamps associated with your usage and details of which of our products and product versions you are using. TABC On The Fly reserves the right to disclose statistical information and other forms of data from our logs that do not contain personal information. In addition, we may use aggregated usage data for other internal business purposes.

TABC On The Fly may also utilize common information-gathering tools such as web beacons, pixels, tags, and JavaScript, alone or in conjunction with cookies, to gather information about the use of our website and emails. For example, we may place a pixel in a marketing email to notify us when you click on a link in the email.

We may place session-based and/or persistent cookies on your device to collect information, including personal information, about your online activities over time and across different sites. The Texas Alcoholic Beverage Commission requires TABC On The Fly to collect personal information from those registering for and completing our online course, and to subsequently transmit the information to them.

TABC On The Fly does not sell your personal information. We may, however, disclose your personal information if required to do so by the Texas Alcoholic Beverage Commission or pursuant to applicable laws, rules or regulations, or in good faith:

  • To comply with legal processes served on the site
  • To protect the rights and property of TABC On The Fly or its affiliated entities
  • Where our records indicate fraudulent activity or other deceptive practices that a governmental agency should be made aware of
  • Where your communication suggests possible harm to others
  • To confirm your certification status with your employer
  • When you instruct us to do so

TABC On The Fly will not share your information with third parties without your permission, other than in connection with the exceptions listed herein. We reserve the right to share your information with contractors or vendors who are performing services for TABC On The Fly.

TABC On The Fly also reserves the right to share your information in connection with any merger, acquisition, sale, financing, or dissolution of all or a portion of TABC On The Fly’s business or assets.

INTERNET COMMERCE AND SECURITY OF YOUR PERSONAL INFORMATION

TABC On The Fly is committed to privacy and security regarding data collected on our site. Our site employs an SSL certificate, which is security technology used for encrypting information transmitted via the Internet. This allows sensitive information to be transmitted securely.

REGISTRATION

To register for our course, you must provide personal information such as first name, last name, email address, street address, city, state, zip code, phone number, date of birth, social security number, and employer. Creating a password is also required so you can securely log in to your account. Additional information may be requested and used to verify your identity during the course, as required by the Texas Alcoholic Beverage Commission. This information may be used to communicate with you regarding products and services for which you express an interest. TABC On The Fly reserves the right to use this information to contact you regarding its products, services, and any special offers.

PAYMENT

To process your payment, you must provide billing information associated with your credit or debit card including the name, card number, expiration date, security code, and billing address. This information is not used for any purpose other than processing your payment. We do not save your complete card number, expiration date, security code, or billing address after the transaction is processed. Your card information is saved by third-party vendors that provide payment processing services and with which we maintain written agreements to ensure your personal and financial data is adequately secured and protected. We will not release, or authorize the release, of your personal or financial information to anyone not involved in processing your transaction.

ACCESS TO YOUR PERSONAL INFORMATION

Your information is available only to a limited number of TABC On The Fly employees, contractors, and vendors who are responsible for maintaining the site, administering the course, and/or submitting such information to the Texas Alcoholic Beverage Commission.

Before providing support, we always take reasonable steps to verify your identity, such as asking you to confirm your first name, last name, date of birth, phone number and/or the email address associated with your account.

SOCIAL MEDIA

Our website may use social media features, widgets and links that are hosted by the social media platforms. When you click on these features, widgets or links from our website, the social media platform may receive information showing that you have visited our website. If you are logged in to your social media account, it is possible that the respective social media network can link your visit to our website with your social media profile. Your interactions with social media platforms are governed by the privacy policies of the applicable social media companies.

DATA RETENTION

As part of our commitment to your privacy and the security of your personal information, TABC On The Fly may establish general practices and limits concerning the use of our website, including without limitation the maximum period of time that we retain your course history, user account, and personal information. Your course history, user account, and personal information will be deleted in compliance with TABC On The Fly’s data retention policy and applicable laws, rules, and regulations. You may not be notified prior to deletion.

APPLICABLE LAW

Our website is hosted in the United States and your use of the website will be transferred to and processed solely under the laws of the United States. If you do not consent to your information being used in according with this Privacy Policy, you should not provide your personal information to TABC On The Fly.

MODIFICATIONS

TABC On The Fly may, in its sole discretion, modify this Privacy Policy at any time. TABC On The Fly will indicate at the bottom of this page the date this Privacy Policy was last revised and any such modifications will become effective on such date. Your continued use of or access to the website after such date constitutes acceptance of the new Privacy Policy.
